Terms of Use

The rules for using Foom Athlete, Foom Coach, the FOOM coach web service, and related services.

1. Agreement and operator

These Terms of Use (the “Terms”) are an agreement between you and Algorithmic Research Group, which operates FOOM (“FOOM,” “we,” “us,” or “our”), for Foom Athlete, Foom Coach, the FOOM coach web service, and related services (together, the “Service”). By creating an account, accepting an invitation, buying a subscription, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Adults only

The Service is currently offered only to people who are at least 18 years old and legally able to enter a contract. You may not create an account, accept a coaching invitation, or use the Service for a person under 18. Coaches may not invite or manage minors through the Service.

3. What FOOM provides

FOOM provides tools for an invited athlete and coach to plan and record workouts, log meals and nutrition estimates, and review progress. FOOM does not provide in-app messaging. FOOM is a software provider. Unless we say so expressly, a coach using FOOM is not our employee, agent, medical provider, dietitian, or representative. Coaches are responsible for their credentials, advice, client relationship, and compliance with professional rules.

4. Not medical advice or an emergency service

Workouts, nutrition targets, meal estimates, and other content in the Service are for general fitness and informational purposes. They are not medical care, diagnosis, treatment, or a substitute for advice from a qualified healthcare professional. Stop exercising and seek appropriate care if you experience pain, dizziness, breathing difficulty, or another concerning symptom. Do not use FOOM for emergencies; contact local emergency services.

5. Accounts and coaching relationships

  • Provide accurate account information and keep your credentials private.
  • Use only your own account and promptly report suspected unauthorized access.
  • Athletes join a coach only through an invitation they choose to accept.
  • Athletes may leave a coach, and coaches may end or archive a relationship.
  • Ending a relationship stops new interaction but may leave prior records available as described in the Privacy Policy.

6. Coaching records and user content

You retain ownership of content you submit. You give FOOM a limited, non-exclusive license to host, process, transmit, display, and make technical copies of that content only as needed to operate, secure, and support the Service and meet legal obligations. Shared workout, meal, and progress records are visible to the connected coach and athlete under the relationship controls.

We may reject, restrict, preserve, or remove content and may suspend or terminate accounts or relationships when reasonably necessary for security, legal compliance, or enforcement of these Terms.

7. AI-assisted meal estimates

Before FOOM sends a meal photo or description to Anthropic for AI analysis, Foom Athlete identifies the provider, explains what will be shared and why, and asks the athlete for permission. Nothing is sent unless the athlete chooses to allow the estimate. Permission can be withdrawn from the Account screen, and nutrition can always be entered manually.

AI output can be incomplete or wrong. It is an estimate that must be reviewed before relying on it and is not medical or dietary advice.

8. Coach subscriptions

Paid coach access is offered as an auto-renewable monthly or annual subscription through Apple. The exact price, billing period, and any trial or offer appear before purchase. Payment is charged to your Apple Account when you confirm. Unless canceled at least 24 hours before the end of the current period, the subscription renews automatically and Apple charges the renewal price shown for the plan. You can manage or cancel in your Apple Account subscription settings. Refund requests are handled by Apple under its rules.

Deleting your FOOM account does not cancel an Apple subscription. Cancel the subscription separately in Apple’s subscription settings to stop future renewal charges. Restore Purchases restores eligible access associated with the current Apple Account.

Apple device and license terms

Subject to these Terms, FOOM grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the applicable app on Apple-branded products that you own or control as permitted by Apple’s usage rules, including permitted Family Sharing. These Terms are between you and Algorithmic Research Group, not Apple. Apple is not responsible for the Service, maintenance, support, warranties, product claims, or intellectual-property claims, except that Apple may provide a purchase-price refund where required by its rules. Apple and its subsidiaries are third-party beneficiaries of this paragraph and may enforce it. Apple’s standard licensed-application terms also apply where required and control if this paragraph provides fewer protections to Apple.

9. Acceptable use

You may not:

  • break the law, violate another person’s rights, or facilitate harm;
  • harass, threaten, exploit, impersonate, defraud, or discriminate against another person;
  • upload malware, probe security controls, scrape the Service, or interfere with its operation;
  • use automated access unless FOOM expressly authorizes it;
  • sell, sublicense, reverse engineer, or copy the Service except where law permits; or
  • use the Service or its outputs to train a competing model or product without written permission.

10. Account deletion and termination

You may permanently delete your account from the account screen after recent authentication and explicit confirmation. Deletion is irreversible and removes account-linked service data subject to limited backup, fraud-prevention, transaction, and legal retention described in the Privacy Policy. We may suspend or terminate access for a material or repeated violation, urgent safety risk, unlawful activity, or conduct that threatens the Service or another person.

11. Service changes

We may improve, change, suspend, or discontinue features. We will provide notice when reasonably practicable if a material change adversely affects paid access. Mobile carrier, internet, Apple, and third-party service availability may affect the Service.

12. Disclaimers and liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” FOOM disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee a fitness, nutrition, coaching, or health outcome or uninterrupted operation.

To the fullest extent permitted by law, FOOM will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, data, goodwill, or business opportunity arising from the Service. Our aggregate liability for a claim will not exceed the greater of US $100 or the amount you paid FOOM through Apple for the Service during the 12 months before the event giving rise to the claim. These limitations do not apply where law prohibits them or to liability that cannot lawfully be limited.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except that mandatory consumer protections in your place of residence continue to apply. Courts with jurisdiction in New York will hear disputes unless applicable law gives you the right to bring them elsewhere.

14. Changes and contact

We may update these Terms. We will post the new effective date and provide any additional notice required by law. Continued use after an update takes effect means you accept the revised Terms. Questions may be sent to support@foom.fitness or through our Support page.
